Cipher Cities is operated by ACID Services Pty Ltd ("ACID"). By accessing or using ACID's Cipher Cities you agree that you have read, understood and agree to be bound by these Terms and Conditions.
THIS IS A BETA RELEASE OF CIPHER CITIES.
You must use the Cipher Cities application only on your own computer or telephone handset.
The Terms and Conditions apply to your use of Cipher Cities.

As Cipher Cities allows the design of games to be played in real world environments, users are responsible for ensuring that the safety of players is at all times paramount. ACID accepts no responsibility for any game content that contributes to accidents or incidents that may injure, affect the well-being of, or infringe the rights of players in any way. You indemnify ACID if any player or other person makes a claim against ACID because of any User Content that you have contributed to Cipher Cities.
When you post User Content to the Site, you authorise and direct ACID to make such copies thereof as ACID deems necessary in order to facilitate the posting and storage of the User Content on the Site. By posting User Content to any part of the Site, you represent and warrant that you have the right to grant to ACID an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part) and distribute such User Content for any purpose (commercial, advertising, or otherwise), on or in connection with the Site or the promotion thereof, to prepare derivative works of, or incorporate into other works, such User Content, and to grant and authorise sublicenses of the foregoing.
You may remove your User Content from the Site at any time. If you choose to remove your User Content, the license granted above will automatically expire, however you acknowledge that ACID may retain archived copies of your User Content. ACID does not assert any ownership over your User Content, rather, as between ACID and you, subject to the rights granted to ACID in these Terms and Conditions, you retain full ownership of all of your User Content and any intellectual property rights or other proprietary rights associated with your User Content.
User Content created with Cipher Cities is not to be employed by users for commercial purposes without prior authorisation. Content that is found to be used for such purposes will be removed.
In order to contact you and provide services to you, ACID may need to collect some "personal information" about you. ACID will need your name, address and email address when you register for its newsletter. You will also be required to provide your name, address and/or email address in order to obtain more information about ACID's products and services. Cipher Cities only collects the personal information that ACID needs in order to provide you with a service.
ACID agrees to use your personal information lawfully. ACID will not collect sensitive information about you through the Site without first asking you for permission.
ACID agrees to take all reasonable steps to ensure that the information it has about you is accurate and up-to-date. You can check the information that ACID holds about you by contacting ACID by email or telephone (details are provided below). If there are any inaccuracies in this information, ACID requests that you inform ACID to ensure that the errors are corrected.
The personal information which ACID holds will be held securely. ACID will take all reasonable steps to keep the information secure and confidential from unauthorised access, misuse or loss.
ACID will only use and disclose the personal information you provide to it for lawful purposes, including those purposes for which it was collected. These lawful purposes include:

General Terms of Use
- By using any part of Cipher Cities, you accept these Terms and Conditions.
- If you do not accept these Terms and Conditions in full, ACID does not consent to your use of Cipher Cities and you must stop using all parts of Cipher Cities immediately.
- You agree to use Cipher Cities only for lawful purposes, and in a manner that does not infringe the rights or inhibit the enjoyment of Cipher Cities by any other person. This includes the content and conduct of any location based games that you may develop with Cipher Cities.
- Cipher Cities and the information, names, images, pictures, and logos regarding or relating to Cipher Cities are in Beta Release phase and do not amount to a commercially released product. Accordingly, Cipher Cities is provided "as is" without any representation or endorsement made and without warranty of any kind whether express or implied.
- You agree to use Cipher Cities at your own risk. ACID will not be liable for any damages including, without limitation, direct or indirect or consequential damages and loss of profits, or any damages arising from the use or in connection with any use of Cipher Cities, whether in contract, negligence or otherwise, to the maximum extent permitted by law.
- ACID does not warrant that the functions in Cipher Cities will be uninterrupted or error-free.
- The Cipher Cities is protected by copyright.
- Commercial use of all or any item displayed on or in any part of Cipher Cities is strictly prohibited without prior written authorisation from ACID.
- Nothing contained in Cipher Cities or in these Terms and Conditions shall be construed as conferring any licence by ACID to you or anyone else to use Cipher Cities in any way other than for the purposes of the Beta Release.
- Documents may be downloaded and copied for personal use only on the condition that the copyright notice and source indications are also copied, no modifications are made and the document is copied entirely.
- Some documents and photos may be published via Cipher Cities with the permission of the relevant copyright owners (not ACID). All rights are reserved on these documents and permission to copy them must be requested from the copyright owners (who are identified by these documents and photographs, or the identity of which may be obtained from ACID).
- Cipher Cities may contain links to other sites. These links are provided solely for your convenience and ACID is not responsible for these other sites in any way. ACID makes no warranties or representations and takes no responsibility for the content or availability of these other sites. ACID does not endorse these sites in any way. You access and use these sites at your own risk.
- You must not frame the Site or the material appearing on the Site in any way without the prior written authorisation of ACID.
- Please see ACID's Privacy Statement (below) for more information about how ACID will protect your privacy and personal information.
- If you decide not to continue with the use of Cipher Cities at any time, you must delete or deliver to ACID any copies of Cipher Cities that you have in your possession.
- At the end of the Beta Release, you must cease use of the Cipher Cities application.
- ACID reserves the right to end the Beta Release at any time, upon notice to you.
- These Terms and Conditions shall be governed by the law in force in Queensland, Australia. ACID may vary these Terms and Conditions upon notice to you. This notice may be given electronically, for example, via email or on the Site.
User Conduct
You understand that except for advertising programs offered by ACID on the Site, Cipher Cities is available for your personal, non-commercial use only. You represent, warrant and agree that no materials of any kind submitted through your account or otherwise posted, transmitted, or shared by you on or through the Service will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libellous, defamatory or otherwise unlawful material.In addition, you agree not to use Cipher Cities to:
- harvest or collect email addresses or other contact information of other users from Cipher Cities by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications;
- use Cipher Cities in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Site;
- use automated scripts to collect information from or otherwise interact with Cipher Cities;
- upload, post, transmit, share, store or otherwise make available any content that we deem to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable;
- register for more than one User account, register for a User account on behalf of an individual other than yourself, or register for a User account on behalf of any group or entity;
- upload, post, transmit, share or otherwise make available any unsolicited or unauthorised advertising, solicitations, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
- upload, post, transmit, share, store or otherwise make publicly available on the Site any private information of any third party, including, addresses, phone numbers, email addresses, government identification numbers and credit card numbers;
- solicit personal information from anyone under 18 or solicit passwords or personally identifying information for commercial or unlawful purposes;
- upload, post, transmit, share or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
- intimidate or harass another user;
- upload, post, transmit, share, store or otherwise make available content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law;
- use or attempt to use another user's account, service or system without authorisation from ACID, or create a false identity.
- upload, post, transmit, share, store or otherwise make available content that, in the sole judgment of ACID, is objectionable or which restricts or inhibits any other person from using or enjoying Cipher Cities, or which may expose ACID or its users to any harm or liability of any type.
Content
You are solely responsible for the photos, profiles (including your name, image, and likeness), messages, games, notes, text, information and other content that you upload, publish or display (hereinafter, "Post") on or through Cipher Cities, or transmit to or share with other users (collectively the "User Content"). You may not post, transmit, or share User Content on Cipher Cities that you did not create or that you do not have permission to post. You understand and agree that ACID may, but is not obligated to, review the Site and may delete or remove (without notice) any Site Content or User Content in its sole discretion, for any reason or no reason, including User Content that, in the sole judgment of ACID, violates these Terms and Conditions, or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of users or others. You are solely responsible at your sole cost and expense for creating backup copies and replacing any User Content you post or store on the Site or provide to ACID.As Cipher Cities allows the design of games to be played in real world environments, users are responsible for ensuring that the safety of players is at all times paramount. Such Third Party Sites and Third Party Applications, Software or Content are not investigated, monitored or checked for accuracy, appropriateness, or completeness by ACID. ACID is not responsible for any Third Party Sites accessed through the Site or any Third Party Applications, Software or Content posted on, available through or installed from the Site, including the content, accuracy, offensiveness, opinions, reliability, privacy practices or other policies of or contained in the Third Party Sites or the Third Party Applications, Software or Content. Inclusion of, linking to or permitting the use or installation of any Third Party Site or any Third Party Applications, Software or Content does not imply approval or endorsement thereof by ACID. If you decide to leave the Site and access the Third Party Sites or to use or install any Third Party Applications, Software or Content, you do so at your own risk and you should be aware that ACID's terms and policies will no longer govern or apply.Monitoring

By playing Cipher Cities you will be subject to standard carrier charges for SMS and/or data transfer. ACID will not be held liable for any damages that may occur resulting from excessive use of these services.
